Overview

On 10 July 2026, Building Tasmania’s State Planning Office (SPO), on behalf of the Minister for Housing and Planning, requested the Commission’s opinion as to whether draft amendment 04-2026 of the SPPs meets the minor amendment criteria under section 30NA(3) of the Land Use Planning and Approvals Act 1993 (the Act).

The draft minor amendment proposes to:

  • remove a potential anomaly that will be created by the discontinuation of issuing certificates of title on 1 September 2026, and clarifying the title information required to accompany a permit application;
  • remove a potential inconsistency between the State Planning Provisions (SPPs) and the Act in the general exemptions and clarifying whether a permit is, or is not, required to be issued under the Tasmanian Planning Scheme (TPS); and
  • clarify how the SPPs apply to permits issued under former planning schemes before the TPS came into effect.

The Commission considered whether the draft minor amendment meets the criteria of the Act and submitted its opinion to the Minister.

Decision

The Minister has determined to make the minor amendment to the SPPs. The effective date is 7 September 2026. A copy of the Minister’s decision and reasons is available on the Planning in Tasmania website.
