Overview
The State Planning Provisions (SPPs) together with Local Provisions Schedules (LPSs) form the Tasmanian Planning Scheme for a municipal area.
On 20 September 2024, the Minister for Housing, Planning and Consumer Affairs requested the Commission’s opinion as to whether a draft minor amendment of the SPPs meets the minor amendment criteria at section 30NA(1) of the Land Use Planning and Approvals Act 1993 (the Act).
The draft minor amendment proposes to:
- include display homes as an exempt use in Table 4.1;
- amend exemption 4.4.1 Vegetation removal for safety or in accordance with other Acts in Table 4.4;
- clarify clause 6.8.2 in clause 6.9 Discretionary Use or Development;
- amend clause C7.4.1(d) in the exemptions for the C7.0 Natural Assets Code; and
- insert a new clause to the application clauses of C9.0 Attenuation Code.
The Commission considered whether the draft minor amendment meets the criteria of the Act and submitted its opinion to the Minister.

The Minister has determined to make the minor amendment to the SPPs with modifications. The effective date is 25 December 2024. A copy of the Minister’s decision and reasons is available on the State Planning Office webpage.
