Overview

The draft amendment proposes to:

  • rezone a 7.89ha portion of land at 612 West Tamar Highway, Legana (folio of the Register 179381/1) from Rural Resource Zone to Community Purpose Zone;
  • amend clause 17.2 – Use Table, for the Community Purpose Zone by inserting the following qualifications within the Permitted use status;
  • Business and Professional Services: ‘If for a medical centre on land described in CT 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot.’

    Community Meeting and Entertainment: ‘If on land described in folio of the Register 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot.’

    Community Meeting and Entertainment: ‘If on land described in folio of the Register 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot.’

    Education and Occasional Care; ‘If for a school on land described in folio of the Register 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot.’

    Sports and Recreation: ‘If on land described in folio of the Register 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot.’

    Utilities: ‘If for a road on land described in folio of the Register 179381/1 (612 West Tamar Highway) or any subsequent subdivided lot,

  • amend clause 26.2 – Use Table, for the Rural Resource Zone by inserting the following qualifications within the Permitted use status; and
  • Utilities : ‘If for a road on a lot subdivided from CT179381/1 (612 West Tamar Highway) for this purpose.’
  • amend clause 26.2 – Use Table, for the Rural Resource Zone by inserting additional text (underlined) in the qualification for the use class under the Discretionary status.

    Utilities:

    ‘If:

    a) For existing uses on prime agricultural land; or

    b) Not for existing uses (except for a new use identified as Permitted); or

    c) The curtilage increases by more than 30% as at the effective date.’
