Issues the Panel will consider for its assessment

 
Draft approval

The proponent suggested through Mr McElwaine at the directions hearing, that a draft approval with conditions appearing appropriate from time to time, be prepared by it and kept updated.  This was accepted as useful by the Panel Chairman.

The Panel is obliged, in the event it recommends approval of the project, to make a recommendation which contains all required conditions.  The Panel needs to first determine whether approval is appropriate.  In order to determine whether approval is appropriate, one consideration is whether or not any given concerns can be adequately covered by conditions.  Such a draft is a useful tool to assist the Panel in making its assessment.  It will also be a useful basis for consideration of conditions in the event of a recommendation for approval. 

This arrangement is not to be taken as in any way an indication the Assessment Panel will recommend either approval or refusal of the project.

 
Proofs of Evidence for the Hearing

It is noted the proofs of evidence do not address all issues the assessment panel has listed as those it will consider for the Draft Integrated Assessment Report.  An updated list of those issues is provided.

Direction to EPA to produce documents
In response to the Commission's direction dated 10 June 2009 to produce documents, the Environment Protection Authority has provided groundwater monitoring records relating to the Lauderdale Tip from 2000-2005, which it is anticipated will give an indication of metal and nutrients present at the site.
That information is available for inspection at the Commission's office - Level 3, 144 Macquarie Street, Hobart - during business hours.

A document entitled “Lauderdale Quay Terrestrial Fauna Impact Assessment: Chequered Blue Butterfly Survey” has been provided by Walker Corporation to supplement the information contained in its Draft Integrated Impact Statement (DIIS).

Whilst the Survey did not form part of the DIIS when publicly exhibited, the Commission has determined to make it publicly available as it contains material relevant to the Commission’s assessment of the proposal.
